Waiver: In consideration for my Organization’s desire to participate in the Mansfield Richland Area’s Educational Foundation program, (“the Program”) I, for myself, my heirs, personal representatives or assigns, and on behalf of the Company, do hereby release, waive, and discharge Mansfield Richland Area Educational Foundation, Richland Area Chamber and Economic Development, their officers, employees, affiliates, subsidiaries and agents from liability from any and all claims due to negligence or accident resulting in personal injury or illness (including death), and property loss arising from my participation in the Program. My Organization also agrees to waive any consequential damages as it relates to participation the Program, including, but not limited to Organization’s loss of income, profit, or financing, as well as the loss of business, principal office overhead and expresses, loss of reputation, or insolvency.
Assumption of the Risk: Participation in the Program carries with it certain risks that cannot be eliminated regardless of the care taken to avoid damages.
I HAVE READ THE PREVIOUS PARAGRAPH AND I KNOW, UNDERSTAND, AND APPRECIATE THESE AND OTHER RISKS THAT ARE INHERENT. I HEREBY ASSERT THAT MY PARTICIPATION IN THE PROGRAM IS AT MY REQUEST AND I KNOWINGLY ASSUME ALL RISKS.
Indemnification and Hold Harmless: I also agree to indemnify and hold harmless Mansfield Richland Area Educational Foundation, Richland Area Chamber and Economic Development, and their officers, employees, agents, affiliates, and subsidiaries from any and all claims, action, suits, procedures, costs, expenses, damage, and liabilities, including attorney’s fees brought as a result of my participation in the Program.
Severability: The undersigned further expressly agrees that the foregoing waiver and assumed risk agreement is intended to be as broad and inclusive as is permitted by the Laws of the State of Ohio, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Acknowledgment of Understanding: I have read this Waiver and Release, fully understand its terms, and understand that I am giving up my rights, including my right to sue. I acknowledge that I am signing the Waiver and Release freely and voluntarily and intend by my signature to complete an unconditional release of liability, to the greatest extent allowed by law. I acknowledge that I have the authority to sign on behalf of the Company.
